A CHARTER ORDINANCE EXEMPTING THE CITY OF CANEY, KANSAS FROM NEW SECTION 4 OF HOUSE BILL 2217 OF THE 2008 KANSAS LEGISLATURE AND PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECT.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF CANEY, KANSAS:

SECTION 1. The City of Caney, Kansas, by the power vested in it by Article 12, Section 5 of the Kansas Constitution, hereby elects to and does exempt itself from and makes inapplicable to it, New Section 4 of House Bill 2217 of the 2008 Kansas Legislature, which provisions are not uniformly applied to all cities.

SECTION 2. In lieu thereof, the Governing Body of the City of Caney, Kansas, hereby adopts the following provisions, to be added to the code of the City of Caney, as section 1-213, to-wit:

1-213. APPOINTMENTS BY MAYOR Except as otherwise provided in this Code, any appointment to any board, commission, advisory group or other body made by the mayor shall be subject to approval of the governing body of the city.
