CHAPTER 12. PUBLIC PROPERTYCHAPTER 12. PUBLIC PROPERTY\Article 1. Swimming Pool

The municipal swimming pool of the city shall be open at all proper and seasonable times, subject to such rules and regulations herein contained and as the governing body may from time to time adopt and authorize and as provided by the rules and regulations of the Kansas State Board of Health.

The governing body shall employ a manager of the swimming pool and the manager shall perform his or her duties at the will and pleasure of the governing body. The manager shall have general super vision over the swimming pool and over all persons attending the same. It shall be his or her duty to preserve order, to enforce all the provisions of this article and the rules and regulations of this article and the rules and regulations of the city and the Kansas State Board of Health and the manager may exclude any person or persons from the pool and its grounds for the violation of this article, such rules and regulations as may be made by the city, or the Kanas State Board of Health. He or she shall act as guard and lifesaver for those in danger and in need of aid, and for this purpose he or she shall be constantly on duty and vigilant at all times. The governing body shall appoint such assistants ·as may be necessary for the proper enforcement of the provisions of this article and the powers and duties of the assistants shall be the same as that of the manager.

It shall be unlawful for any person to enter the enclosure or fence of the swimming pool in any other manner than through the gate or entrance provided therefore, or to climb on or over the fence forming the enclosure, or to enter the enclosure at any other time than when the pool is open for admittance to any such person, except by the authority and consent of the governing body.

It shall be unlawful for any person at any time to enter the swimming pool who is afflicted with any contagious or infectious disease. The manager of the pool is hereby authorized, directed and empowered within his or her discretion to require from any person requesting permission to enter the swimming pool a certificate of health from a licensed doctor of medicine dated within three days of the date admission is sought, stating that the person applying for admission to the pool is free from any infectious or contagious disease, which might endanger the health of other occupants of the pool.

It shall be unlawful for any person to enter the swimming pool without first taking a cleansing shower in the nude with warm water and soap.

(Ord. 579, Sec. 5)

It shall be unlawful for any person or persons to enter the waters of ·the swimming pool, at any time, in any clothing or apparel other than a bathing suit, except if the person is taking a supervised course in life saving.

(Ord. 579, Sec. 6)

The manager is hereby authorized, directed and empowered to refuse admission to any person applying for admission to the pool, who is intoxicated or under the influence of drugs or opiates or any person having on his or her person any open sores, wounds, cuts, rash, skin eruption or whose appearance shall give evidence of any skin or blood disease.

It shall be unlawful for any person or persons to throw or place in the waters of the pool any stones, debris, ref use or discarded substances or articles of any kind; it shall be further unlawful for any person or persons in any manner willfully to pollute the waters of the pool.

(Ord. 579, Sec. 8)

It shall be unlawful at all times for any person or persons to place in the waters of the swimming pool or to cause or to suffer any dogs or any animals of any kind to enter or be therein.

Any person who shall conduct himself or herself in a disorderly or indecent manner in or about the pool or who shall ref use or f ail to observe the regulations established for its use may, in the discretion of the manager or person in charge of · the pool, be removed therefrom and thereafter ref used admission to the pool.

All children under the age of seven years shall be accompanied by a parent or guardian or by some adult who shall be responsible for their safety and conduct while in the pool; provided, that in lieu thereof written permission of such parent or guardian may be filed subject to the approval of the manager, with the manager authorizing such child or children to be in the pool unaccompanied.

The admission rates governing the use of the pool shall be fixed by the governing body and a copy of such charges shall be posted in a conspicuous place near the entrance thereto.

(Ord. 579, Sec. 12)

The governing body is hereby authorized to make and enforce such additional rules and regulations as may be necessary for the management and operation of the swimming pool. Copies of all rules shall be posted in conspicuous places about the swimming pool.

(Ord. 579, Sec. 13)

The hours during which the swimming pool shall be open shall be determined by the governing body. It shall be unlawful for any person or persons to enter the waters of the pool except when the manager or a lifeguard is in charge of the same and on duty, without first having made arrangements with the governing body to do so.

(Ord. 579, Sec. 14)

Every person shall sign his or her name in a register to be provided by the governing body for such purpose, before such person shall enter and use the swimming pool.
