CHARTER ORDINANCE EXEMPTING THE CITY OF CANEY, KANSAS, FROM SECTION 14-679 OF THE 1949 STATUTES OF KANSAS, PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT, AND PROVIDING FOR THE SELECTION OF A BOARD OF TRUSTEES OF THREE MEMBERS, THEIR TERMS OF OFFICE, QUALIFICATIONS, DUTIES, REMOVAL AND FILLING OF VACANCIES.

Section 1. That the City of Caney, Kansas, a mayor-council city of the second class, by the power invested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to and exempts itself from and makes inapplicable to it Section 14-679 of the General Statutes of Kansas, 1949, being a part of Chapter 163, laws of Kansas, 1947, which applies only to cities of the second class located in a county having a population of not more than 50,000 with a total assessed taxable tangible valuation of not less than $60,000,000.00, and to provide substitute and additional provisions as hereinafter provided.

Section 2. (a) There is hereby created a board of three trustees selected from the citizens of Caney, Kansas, with reference to their fitness for such office and who upon their appointment and qualification, shall constitute a board of trustees for the Caney Municipal Hospital.

(b) Said board of trustees shall be appointed by the mayor and confirmed by the city council. In case any appointee is not confirmed by the council then a new name shall be submitted for confirmation.

(c) Their term of office shall be for three years. However, the first three members shall hold office as follows: One member to hold office for a period of one year, one member to hold office for a period of two years, and one member to hold office for a period of three years. After the expiration of the terms of the first three members of said board, those thereafter appointed shall serve for a full term of three years. In case of a vacancy, a successor of such member, vacating such office, shall be appointed by the mayor and confirmed by the council for the unexpired term.

(d) Any trustee appointed herein may be removed for just cause and/or upon the recommendation of five or more members of the city council of Caney.
